We handle cases involving the crime of illegal reentry to the US. This usually involves an alien who was formally removed or excluded, who thereafter has entered, attempted to enter or has been found in the United States, and did not have consent to do so.
- As Immigration experts, we have an advantage to defend these cases, particularly when we can show the original deportation order was obtained unlawfully or as a violation of the client’s due process rights. If a Removal Order was obtained unlawfully, the Supreme Court has ruled as a matter of due process that that order may not be used as the basis for a Re-Entry conviction. For example if the deportation proceeding can be shown to have been “fundamentally unfair”, and the alien was in some way deprived of judicial review, and the defect prejudiced the alien, depriving him of what would otherwise have been a reasonable likelihood of avoiding removal.
