A federal judge on Friday blocked the Trump administration from implementing a rule, set to take effect next week, that would have closed the doors of the United States to most asylum seekers.
The sweeping clampdown on asylum would have prevented a large swath of people from qualifying for protection in the United States by narrowing eligibility. Applicants who had not first sought asylum in a transit country through which they had passed; had lived in the United States for a year without permission or had claimed persecution based on sexual orientation would be disqualified. Judge James Donato of the U.S. District Court for Northern California issued a nationwide injunction on procedural grounds, saying that the acting Homeland Security secretary, Chad Wolf, lacked authority to impose the rule because he had not been properly confirmed for his position. Family immigration of US citizens and residents declined by about 24 percent compared to 2016 because the Trump administration slowed processing and doubled the denial rate. But things came to a near complete halt during the pandemic. In May, the administration allowed a measly 782 immigrants in this category compared to the monthly average of 55,000 four years ago. How did Stephen Miller accomplish this feat? He used the pretext of the pandemic to shut down consular offices so that they could no longer conduct the mandatory in-person interviews. On Nov. 18, 2016 I had my interview with USCIS and got approved to be a resident. The joy was overwhelming but it didn’t feel real, even after I received my resident card a few days before my 28th birthday, I had mixed feelings. I still know many people that are in the situation I was in. I came to the U.S. when I was 4 years old, went to school K-12 in Oceanside, CA. Graduated from CSUSM with a bachelors degree in Human Development and a minor in Sociology. Through it all I have faith that God has always been watching over me, providing me with every opportunity I’ve had. Through DACA, I was able to apply for advanced parole to leave the country and have a “legal” entry which then allowed me to “adjust” my status through marriage to Edward (a U.S. citizen). At age 28, I could finally say I am a United States resident and I owe it to Edward and the lawyer who helped us. Anna Hysell gave us an honest and professional opinion from the beginning. She was positive and realistic about it all. If it weren’t for her passion and dedication to focus her expertise on immigration I wouldn’t have what I have today.
