Provisional Unlawful Presence Waiver Granted (I-601A)……..

NCI was pleased to get a Provisional Waiver granted for Unlawful Presence, so that a local man could remain with his wife and two children.  Despite accumulating unlawful presence in the United States, USCIS will examine whether a qualifying relative would suffer an extreme hardship.  In this case, NCI was able to provide enough evidence and arguments that this family could not remain financially stable enough to support themselves should a separation or forced relocation to Mexico occur.  It is important to remember that Extreme hardship can be proven on several different grounds, such as medical issues, emotional issues, or financial difficulties, and USCIS will consider all relevant evidence in its Hardship Determinations for I-601 and I-601a waivers.
